ARTICLE 1 – PURPOSE AND SCOPE
These General Terms and Conditions of Sale govern the contractual relationship between the company MY TRAVEL ST BARTH, an SAS currently registered in Basse-Terre, with its registered office located in Camaruche, 97133 Saint-Barthélemy, and any person (hereinafter referred to as “the Client”) wishing to book one or more services offered by the agency via the website https://mytravelstbarth.com, by email, telephone, or any other means.
These GTC apply to all services offered, including:

Private and scheduled charter flights

Boat rentals
-
VIP Services (airport, concierge)
-
Villa rentals and hotel accommodation
-
Private events
-
Water sports and wellness activities
ARTICLE 2 – ROLE OF THE AGENCY
My Travel St Barth acts as an intermediary between the client and third-party providers (airlines, shipping companies, hotels, concierges, villa owners, etc.). It does not directly own or operate the transportation, accommodation, or activities offered.
The final service provider is solely responsible for the proper execution of the service. In the event of delay, cancellation, or modification, My Travel St Barth cannot be held liable, except in the case of proven fault on the part of the agency.
ARTICLE 3 – MODIFICATIONS, CANCELLATIONS AND DELAYS
3.1 Charter / Scheduled Flights & Boats
Any modification of date, time, or passengers after confirmation may incur fees according to the carrier’s conditions and processing fees applied by the agency.
In case of client delay or no-show, no refund will be issued.
In case of cancellation by the company (charter or regular), refund terms depend on the carrier. The agency undertakes to inform the client but cannot be held responsible for the final decision.
3.2 VIP Services

From November 1st to May 31st: services are non-refundable, but modifiable with fees.

From June 1st to October 31st:

Cancellation +30 days prior: 50% fee

Cancellation between 30 and 7 days: 75% fee

Cancellation -7 days: non-refundable

Agency fees of €30 per booking and 3% bank charges will be applied to any refund or modification.
3.3 Villa & Hotel Rentals
Specific conditions are detailed in the rental agreement. Otherwise:

30% deposit upon booking, balance 60 days before arrival.

Cancellation +90 days: deposit refund (excluding fees)

Cancellation between 90 and 60 days: deposit forfeiture

Cancellation -60 days: 100% due
During holidays (Christmas/New Year):

50% deposit, balance 90 days prior

Cancellation +91 days: deposit refund (excluding fees)

Cancellation between 90 and 60 days: 50% due

Cancellation -60 days: 100% due
3.4 Boat Rentals & Sea Transfers
Boat rentals and sea transfers are subject to specific conditions:

Booking confirmed only after full payment.

Cancellation:

+7 days prior: 5% fee
-
Between 7 days and 48 hours: 50% fee
-
Less than 48 hours or no-show: non-refundable
-
For overnight rentals: non-refundable, but modification possible (+30 days) with fees.

Weather conditions:
-
In case of alert or closed port: departure decision or postponement on the same day.

If departure is impossible: postponement or refund excluding meals.

Flight delay for transfer:

Between 1 and 3 hours: additional fees may apply

+3 hours: cancellation without refund

Meals on board: included if booked in advance, 50% surcharge for late orders (after 5 PM the day before).

Children:
-
Full-day offshore fishing: prohibited for children under 7 years old
-
Half-day: coastal fishing only with children under 7 years old

Third-party meals: refusal possible if non-compliant (cold chain)

Payment accepted:

Bank transfer / cash (within legal limits)

Checks not accepted

Departures/returns:

Port of Gustavia according to fixed schedule

Other location possible with prior agreement

ARTICLE 4 – WEATHER CONDITIONS & FORCE MAJEURE
In case of unfavorable weather conditions preventing the proper execution of a service (flight, boat, activity), the service will be rescheduled according to provider availability. No automatic refund will be issued.
In case of force majeure (natural disaster, pandemic, war, riot, strike, unforeseen breakdown, etc.), My Travel St Barth cannot be held liable. No compensation can be claimed.
ARTICLE 5 – CHECK-IN, NO-SHOW & DOCUMENTS

Recommended check-in 90 minutes before departure

Check-in deadline: 45 minutes

In case of no-show: no refund
Schedules are subject to change. The client is responsible for checking information sent by email. In case of non-receipt, they must contact the agency.
ARTICLE 6 – SECURITY DEPOSIT (VILLAS)
A credit card security deposit may be required to cover potential damages. In case of damage or incident, the agency reserves the right to charge the necessary amount (plus a 5% processing fee).
ARTICLE 7 – RATES, PAYMENT & PENALTIES
Rates are expressed in euros or dollars, net of VAT (not applicable in Saint-Barthélemy).

Secure online payment (upon request)
Any order is considered confirmed upon receipt of payment (deposit or full amount). In case of late payment:

Legal interest + fixed compensation of €40 (Art. L441-6 of the Commercial Code)

In case of dispute, the person signing the booking form assumes responsibility.
For any urgent request (less than 24 hours) or night service (7 PM – 7 AM), additional fees may apply.
ARTICLE 8 – TOURIST TAX
In accordance with Saint-Barthélemy regulations, a 5% tourist tax is levied on the pre-tax amount of accommodation. It is collected at the time of payment and remitted to the Collectivity.
ARTICLE 9 – CLIENT RESPONSIBILITY
The client is required to respect the locations, schedules, and conditions communicated. In case of damage, inappropriate behavior, or non-compliance with safety rules, the service provider or the agency reserves the right to interrupt the service without refund.
The client is also responsible for the information provided for booking (names, dates, passports, etc.).
ARTICLE 10 – INSURANCE
It is highly recommended to purchase multi-risk travel insurance including:

Delay or modification

Lost luggage

Civil liability
-
Medical repatriation
The agency disclaims all responsibility for any uncovered issues.
ARTICLE 11 – PERSONAL DATA
Data collected via the website or forms is used exclusively for booking management, customer follow-up, and commercial communication (with consent).
In accordance with GDPR, the client has the right to access, rectify, delete, or port their data. Requests should be sent to info@mytravelstbarth.com.

ARTICLE 12 – APPLICABLE LAW & JURISDICTION
These GTC are subject to French law.
In case of dispute, the competent jurisdiction is that of the Court of Basse-Terre (Guadeloupe).
