MY TRAVEL ST BARTH

1. INTRODUCTION
These Terms & Conditions govern all services offered by My Travel St Barth (the « Agency »), including but not limited to scheduled flights, private aviation, helicopter transfers, airport assistance, VIP services, yacht charters, maritime transfers, accommodations, villa rentals, concierge services, transportation, vehicle rentals, activities, private events, wellness experiences, marriage proposals and bespoke travel experiences.
By requesting a quotation, accepting a proposal, confirming a reservation, making a payment, validating an online payment request or using any service arranged by My Travel St Barth, the Client acknowledges having read, understood and accepted these Terms & Conditions in their entirety.
These Terms & Conditions supersede any previous version and apply to all quotations, invoices, booking confirmations, client portal reservations and payment requests issued by My Travel St Barth.
2. AGENCY STATUS
My Travel St Barth acts solely as an intermediary between the Client and independent third-party suppliers, including airlines, charter operators, helicopter companies, hotels, villa owners, yacht operators, transportation providers, activity providers, event planners, concierge partners and service companies.
The Agency does not own, operate or directly provide aircraft, vessels, accommodations, transportation services, restaurants, vehicles or activities.
Each supplier remains solely responsible for the execution of its services and compliance with applicable regulations, safety standards and operational procedures.
My Travel St Barth shall not be held liable for delays, schedule modifications, operational disruptions, supplier insolvency, technical failures, weather events, governmental restrictions, strikes, airport closures, port closures or any circumstance beyond its reasonable control.
3. QUOTATIONS AND AVAILABILITY
All quotations remain subject to availability at the time of confirmation.
Prices, schedules, inventories and supplier availability may change without prior notice until payment has been received and written confirmation has been issued.
Unless otherwise specified, quotations remain valid for twenty-four (24) hours.
Reservations are deemed confirmed only upon receipt of payment and written confirmation from My Travel St Barth.
The Agency reserves the right to modify, amend or withdraw a quotation prior to confirmation.
Manifest pricing errors shall not create contractual obligations.
4. PRICES
Prices are expressed in Euros (EUR) or United States Dollars (USD).
Saint-Barthélemy benefits from a specific tax regime and VAT is generally not applicable.
Prices may include or exclude airport taxes, handling fees, fuel surcharges, marina fees, resort fees, tourist taxes, concierge fees, crew gratuities, payment processing fees and supplier service charges.
These elements shall be specified whenever applicable.
My Travel St Barth reserves the right to correct pricing errors, supplier adjustments or administrative inaccuracies.
5. PAYMENTS
Payments may be made by bank transfer, Visa, Mastercard, American Express or secure online payment link.
A deposit and/or full payment may be required depending on supplier conditions and the nature of the services booked.
Any reservation shall be considered confirmed only upon receipt of payment.
Online payments may be subject to a processing fee of up to three percent (3%).
Bank transfer fees, intermediary bank charges, exchange fees and payment processing costs remain the responsibility of the Client.
Failure to pay within the specified timeframe may result in cancellation of the reservation.
Urgent requests, last-minute bookings, same-day services and services requested outside standard business hours may incur additional charges.
6. FLIGHTS AND AIR TRANSPORTATION
Scheduled flights, charter flights, helicopter services and private aviation remain governed by the operating carrier’s conditions of carriage.
Schedules, departure times, aircraft types, baggage allowances and routing may be modified for operational reasons.
Passengers are solely responsible for ensuring the accuracy of all information provided, including names, dates of birth, passport details, nationality and travel documentation.
My Travel St Barth shall not be held responsible for denied boarding, denied entry, immigration refusal, missed connections or additional expenses resulting from incomplete, inaccurate or invalid documentation.
Private aviation services are generally non-refundable once confirmed unless otherwise specified.
Unused flight segments, missed departures and no-shows remain entirely non-refundable.
Airlines and operators remain solely responsible for delays, technical issues, weather disruptions, crew shortages, operational decisions and airport restrictions.
7. VIP SERVICES
VIP services may include airport meet and greet assistance, fast-track formalities, priority arrival and departure services, baggage assistance, concierge coordination, escorted connections, airport check-in assistance, luggage collection from accommodations and personalized transportation.
VIP services remain subject to availability, airport regulations and operational approval.
Unless otherwise specified, VIP services become non-refundable upon confirmation.
Modification requests may be accepted subject to operational feasibility, supplier approval and applicable administrative fees.
For services including luggage and passport collection, Clients must ensure that baggage, passports and required travel documents are available at the agreed location and collection time.
Failure to comply with collection procedures may result in cancellation of the service without refund.
Airport authorities, customs procedures, immigration regulations and security requirements may affect the execution of VIP services without entitling the Client to compensation.
8. BAGGAGE COLLECTION SERVICES
For services involving baggage collection from hotels, villas or private residences, Clients acknowledge that luggage, passports and travel documents must be available at the agreed location and time.
My Travel St Barth shall not be held liable for forgotten items, unavailable luggage, incorrect baggage identification, missing travel documents or delays caused by the Client.
Additional charges may apply if modifications are requested after confirmation.
9. HOTELS, VILLAS AND ACCOMMODATIONS
Accommodation reservations remain subject to supplier-specific conditions, which may supersede these Terms & Conditions.
Unless otherwise specified, a deposit may be required upon confirmation, with the remaining balance generally payable prior to arrival according to supplier payment schedules.
Certain periods, including festive season bookings, may be subject to stricter payment and cancellation conditions.
A tourist tax of five percent (5%) shall be applied to hotel and villa stays in accordance with Saint-Barthélemy regulations. This tax may be collected by My Travel St Barth, by the accommodation provider or directly upon arrival, depending on supplier procedures.
Security deposits may be requested by hotels, villa owners or management companies and remain the sole responsibility of the Client.
Clients remain liable for damages caused during their stay.
Occupancy limits established by property owners or management companies must be respected at all times.
Unauthorized events, gatherings or additional guests may result in immediate termination of occupancy without refund.
10. YACHT CHARTERS AND MARITIME SERVICES
Boat rentals, yacht charters and maritime transfers remain subject to weather conditions, port authority decisions and captain approval.
Departure times may vary according to operational constraints.
Services may be postponed, rescheduled or cancelled in accordance with supplier policies.
Additional fees may apply for special catering requests, premium beverages, waiting time, crew gratuities, overtime services and fuel supplements.
Flight delays affecting maritime transfers may generate additional costs.
No compensation shall be due in the event of cancellation for safety reasons.
11. PRIVATE EVENTS
Private events, celebrations, marriage proposals, weddings and bespoke experiences are custom-designed services.
Once suppliers have been contracted, deposits are generally non-refundable.
Decorations, flowers, photographers, musicians, venues, restaurants and catering services remain subject to availability.
Outdoor events remain dependent upon weather conditions and may require relocation or schedule modifications.
No compensation shall be due in the event of modifications required for safety or operational reasons.
12. MODIFICATIONS
Any modification requested after confirmation may result in supplier penalties, fare differences, administrative fees and additional charges.
Modifications remain subject to availability and supplier approval.
My Travel St Barth cannot guarantee that requested changes will be possible.
Administrative fees may apply to any modification request.
13. CANCELLATIONS
Cancellation policies vary according to the services booked.
Supplier-specific conditions shall always prevail.
Unless otherwise specified, services cancelled more than ninety (90) days prior to arrival or departure remain subject to supplier conditions.
Between ninety (90) and sixty (60) days deposits may be retained.
Less than sixty (60) days prior to travel, services may become fully non-refundable.
VIP services, private aviation, charter flights, concierge arrangements, events and bespoke experiences are generally non-refundable once confirmed.
Bank charges, payment processing fees and administrative expenses remain non-refundable.
14. FORCE MAJEURE
My Travel St Barth shall not be liable for any delay, interruption or failure to perform services resulting from circumstances beyond its reasonable control including but not limited to natural disasters, cyclones, storms, pandemics, epidemics, governmental restrictions, political instability, terrorism, airport closures, port closures, strikes, technical failures, supplier insolvency and air traffic restrictions.
Whenever possible, alternative arrangements or rescheduling options may be proposed.
No compensation, indemnity or damages shall be payable.
15. CLIENT RESPONSIBILITY
Clients are responsible for verifying all travel documents, schedules, itineraries and reservation details.
Clients must notify the Agency immediately in the event of discrepancies.
Failure to provide accurate information may result in denied boarding, additional expenses or cancellation without refund.
Clients are expected to behave respectfully toward suppliers, employees, crew members and guests.
Any inappropriate behavior, unlawful activity or breach of safety regulations may result in immediate termination of services without refund.
16. INSURANCE
Clients are strongly encouraged to purchase comprehensive travel insurance covering trip cancellation, interruption of travel arrangements, medical expenses abroad, emergency evacuation, repatriation, lost or delayed baggage, flight disruptions, weather-related events and personal liability.
My Travel St Barth shall not be held liable for losses, expenses or damages that could have been covered under an insurance policy.
17. PERSONAL DATA
Personal information collected by My Travel St Barth is used exclusively for reservation management, supplier coordination, customer service and communications.
Information may be shared only with suppliers directly involved in the execution of services.

18. DISPUTES
Any dispute relating to the interpretation or execution of these Terms & Conditions shall first be subject to an attempt at amicable settlement.
Failing amicable resolution, disputes shall fall under the exclusive jurisdiction of the competent courts of Basse-Terre, Guadeloupe.
French law shall govern these Terms & Conditions.
19. MODIFICATION OF TERMS
My Travel St Barth reserves the right to amend these Terms & Conditions at any time.
The version applicable shall be the one published on the Agency’s website at the date of booking.
20. ACCEPTANCE
The Client acknowledges having read, understood and accepted these Terms & Conditions.
Acceptance shall be deemed effective upon confirmation of apar quotation, electronic acceptance, signature of a booking confirmation, payment of a deposit, payment in full, validation of an online payment request, acceptance through the Client Portal or use of any service arranged by My Travel St Barth.
Acceptance of a quotation, invoice, reservation confirmation, secure payment link, booking confirmation or online proposal constitutes full, irrevocable and unconditional acceptance of these Terms & Conditions.
