ARTICLE 1 – PURPOSE AND SCOPE
These General Terms and Conditions of Sale govern the contractual relationship between MY TRAVEL ST BARTH, a simplified joint-stock company (SAS) currently being registered in Basse-Terre, with its registered office located in Camaruche, 97133 Saint-Barthélemy, and any individual or entity (hereinafter referred to as the “Client”) wishing to book one or more services offered by the agency via the website https://mytravelstbarth.com, by email, phone, or any other means.
These Terms & Conditions apply to all services offered, including but not limited to:
- Private and scheduled charter flights
- Yacht and boat rentals
- VIP services (airport assistance, concierge)
- Villa rentals and hotel accommodations
- Private events
- Water activities and wellness services
ARTICLE 2 – ROLE OF THE AGENCY
My Travel St Barth acts solely as an intermediary between the Client and third-party service providers (airlines, yacht operators, hotels, concierges, villa owners, etc.). The agency does not own or directly operate any transportation, accommodation, or activity services.
The final service provider is solely responsible for the proper execution of the service. In the event of delay, cancellation, or modification, My Travel St Barth cannot be held liable unless a proven fault attributable to the agency is established.
ARTICLE 3 – MODIFICATIONS, CANCELLATIONS & DELAYS
3.1 Charter Flights / Scheduled Flights & Boats
Any modification (date, time, passengers) after confirmation may result in additional charges according to the carrier’s terms and agency processing fees.
In case of delay or no-show by the Client, no refund will be issued.
In case of cancellation by the carrier (charter or scheduled), refund conditions depend solely on the carrier. The agency will inform the Client but cannot be held responsible for the final decision.
3.2 VIP Services
November 1st to May 31st:
Non-refundable services, but modifications are possible subject to fees.
June 1st to October 31st:
- Cancellation more than 30 days prior: 50% fee
- Cancellation between 30 and 7 days: 75% fee
- Cancellation less than 7 days: non-refundable
A €30 agency fee per booking and 3% bank processing fee will apply to any refund or modification.
3.3 Villa Rentals & Hotels
Specific conditions are detailed in the rental agreement. Failing that:
- 30% deposit at booking, balance due 60 days prior to arrival
- Cancellation more than 90 days: deposit refunded (excluding fees)
- Cancellation between 90 and 60 days: deposit retained
- Cancellation less than 60 days: 100% due
Festive Season (Christmas/New Year):
- 50% deposit, balance due 90 days prior
- Cancellation more than 91 days: deposit refunded (excluding fees)
- Cancellation between 90 and 60 days: 50% due
- Cancellation less than 60 days: 100% due
3.4 Boat Rentals & Maritime Transfers
Boat rentals and transfers are subject to specific conditions:
Booking:
Confirmed only upon full payment.
Cancellation Policy:
- More than 7 days: 5% fee
- Between 7 days and 48 hours: 50% fee
- Less than 48 hours or no-show: non-refundable
Overnight charters:
Non-refundable but modifiable (+30 days minimum) subject to fees.
Weather Conditions:
- In case of port closure or weather alert: decision made same day
- If departure is not possible: rescheduling or refund (excluding meals)
Flight Delay (for transfers):
- Between 1 and 3 hours: additional fees may apply
- Over 3 hours: considered cancelled, non-refundable
Onboard Catering:
Included if pre-booked; 50% surcharge for late orders (after 5 PM the day before)
Children Policy:
- Deep sea fishing (full day): not allowed under 7 years old
- Half-day: coastal fishing only for children under 7
External Catering:
May be refused if not compliant with food safety standards
Accepted Payments:
- Credit card (Visa, Mastercard, Amex)
- Bank transfer / cash (within legal limits)
- No checks accepted
Departure / Return:
- Gustavia harbor (fixed schedule)
- Alternative locations possible upon prior agreement
ARTICLE 4 – WEATHER CONDITIONS & FORCE MAJEURE
In case of adverse weather conditions preventing the proper execution of a service (flight, boat, activity), the service will be rescheduled subject to availability. No automatic refund will be issued.
In case of force majeure (natural disaster, pandemic, war, riots, strikes, unforeseen technical failure, etc.), My Travel St Barth cannot be held liable. No compensation shall be due.
ARTICLE 5 – CHECK-IN, NO-SHOW & DOCUMENTS
- Recommended arrival: 90 minutes before departure
- Check-in deadline: 45 minutes prior
- No-show: no refund
Schedules are subject to change. The Client is responsible for checking information sent by email. In case of non-receipt, the Client must contact the agency.
ARTICLE 6 – SECURITY DEPOSIT (VILLAS)
A security deposit via credit card may be required to cover potential damages. In case of damage or incident, the agency reserves the right to charge the necessary amount (plus 5% processing fee).
ARTICLE 7 – PRICING, PAYMENT & PENALTIES
Prices are expressed in euros or US dollars, net of VAT (not applicable in Saint-Barthélemy).
Accepted payment methods:
- Credit card (Visa, Mastercard, Amex)
- Bank transfer
- Secure online payment (upon request)
Any booking is confirmed upon receipt of payment (deposit or full amount).
In case of late payment:
- Legal interest + fixed indemnity of €40 (French Commercial Code, Article L441-6)
The person signing the booking form is legally responsible for the reservation.
For urgent requests (less than 24 hours) or night services (7 PM – 7 AM), additional charges may apply.
ARTICLE 8 – TOURIST TAX
In accordance with Saint-Barthélemy regulations, a 5% tourist tax applies to the pre-tax accommodation amount. It is collected at the time of payment and remitted to the local authorities.
ARTICLE 9 – CLIENT RESPONSIBILITY
The Client must respect all locations, schedules, and instructions provided. In case of damage, inappropriate behavior, or breach of safety rules, the service provider or agency reserves the right to terminate the service without refund.
The Client is also responsible for the accuracy of all information provided (names, dates, passport details, etc.).
ARTICLE 10 – INSURANCE
Clients are strongly advised to purchase comprehensive travel insurance covering:
- Cancellation
- Delays or changes
- Lost luggage
- Personal liability
- Medical repatriation
The agency declines all responsibility for issues not covered by insurance.
ARTICLE 11 – PERSONAL DATA
Personal data collected via the website or forms is used exclusively for booking management, customer follow-up, and marketing communication (with consent).
In accordance with GDPR, the Client has the right to access, rectify, delete, or transfer their data. Requests should be sent to: info@mytravelstbarth.com

ARTICLE 12 – APPLICABLE LAW & JURISDICTION
These Terms & Conditions are governed by French law.
In the event of a dispute, jurisdiction is assigned to the Basse-Terre Court (Guadeloupe).
